The Mission of the Artpage101 platform is To Make Buying High Quality and Original Paintings as Easy as Possible. This includes having certain functionalities like display gallery of artworks, adding items to cart and completing payments online.

Personal data is data that personally refers to you, including and not limited to name, residence address, email address and online user behaviour.

If you interact with this website for information purposes only, we only collect data that your browser sends to us, like your I.P address, dwell time, and Language.

If you interact with our website using any of our forms or manually inputting data, which includes and is not limited to leaving comments and reviews, completing email subscription forms, creating an account application form, and clicking on buttons that submit data. This means you voluntarily send or allow data to be sent to us, and agree to our License and Permission to use your content.

We respect your privacy and security, which is why we take certain measures to ensure that our website is secure, along with practicing fair use of your date. By using this website, you are agreeing to our Privacy Policy, regardless of whether you are a registered user.

Use of Our Services

 

Purchasing Artworks

All prices on our website are stated in United States Dollars, since it is widely used and convenient for our international market.

When you place an order with us, you demonstrate the intention to buy. This will involve the complete payment of the said artwork(s) intended to buy.

When we have proof of full payment, you therefore enter into contract with us.

** We can refuse any purchase or entering into contract for anyone and at anytime for works on Sale of Custom order, without giving reason why.

We make every effort possible to ensure images of artworks are displayed in truth as is possible, including and not limited to colors and forms as they appear on the website. We cannot however, guarantee the accuracy of your monitors to display our photos as is on our website.

Artworks will be shipped to the address you entered while completing order. You will take full responsibility for goods damaged or stolen in the even of you not being at home or directing the delivery company to leave your package(s) unattended.

Please check the goods on delivery, any damages should be reported to the delivery driver at the time of delivery, or to us within a reasonable time of one week.

We cannot be held responsible for undeliverable packages due to location or other unforeseen events. In such cases the artwork(s) may be delivered back to us, and you will be entitled to a full or partial refunds as is applicable by the state of the returned item.  

Any contract we enter will be governed by the Laws of Jamaica.

License of Purchased Artworks

After purchasing artwork(s) from us, either on Sale or a Custom Painting, you are entitled to a Non-exclusive License to your artwork(s) as in accordance with the conditions below.

This Non-exclusive License agreement will forever include only two parties, being ‘You’ the customer, and ‘Us’ the business ‘ART PAGE 101.’

Please see below the share of rights between the ONLY two said parties in this License Agreement.

Your rights (‘You the customer’):

You are the primary owner of the artwork(s). This means you have the License to and is not limited to:

 

  • Resell or Rent your purchased artworks.
  • Publicly Display in however medium, which is not limited to Print or Digital.
  • Tampering or making amendments to the artwork in any way.
  • Creating new Licensing agreements with other parties to use the artwork(s) that are outside the PRIMARY Agreement between ‘YOU’ the customer, and ‘US’ the business ‘ART PAGE 101.’

 

*However, ‘You’ the customer, DO NOT have the right to change the Original Creator of the artwork who by default should always be the business name ‘ART PAGE 101’, once it has been subject to tampering. This includes and is not limited to:

  • Physical and Digital renderings of the artwork(s).  

Our rights (‘Us’ the business ‘ART PAGE 101’)

This is only granted once the use is for the sole purpose of adding to the business ‘ART PAGE 101’s Marketing efforts, and will never include being in close proximity to the physical artwork(s) itself.

This includes and is not limited to:

  • Displaying photos of the artwork(s) in Print and Digital Media *(like adding it to our collection of SOLD PAINTINGS on our website, Sharing photos on Social Media etc.)
  • Referring to the location &/ or new owner of the artwork(s), which may include ‘YOU’ the customer, whether it be a Personal Name, Business Name, Commercial Address of the location if applicable etc.

*However, we do not have the rights to anything outside of the scope of Marketing, which includes and is not limited to the below:

  • We cannot take it back, unless a return agreement which can only be initiated by ‘You’ the customer, has been agreed upon.

 

We will never publicly share information about you personally as an individual, that will reveal your location identity without your consent.

Use of other Media channels

 

This means any other media channels a part from our website that enables you to communicate with us, and is operated by us. This includes and is not limited to whatsapp group, our email newsletter and social media platforms.

Our Privacy Policy is outlined in our Privacy Policy section. By using other media channels that are operated by us, you are agreeing to our Privacy Policy, regardless of Privacy policy bounding the associated media channel.
